The term "Adsparo," "us," "we," or "our" in this privacy policy notice pertains to Adsparo Inc. The terms "you" and “its” designate businesses that opt to utilize Adsparo for marketing their services/products across various digital platforms.

    Our Services

    Adsparo offers a suite of digital marketing services. Our web platform allow you to connect your Facebook and Instagram accounts(s) for easy promotion of your services and products. Adsparo helps its users create, manage, track, schedule, and post different forms of Campaigns(Content). By associating your current social media and account(s) with your Adsparo account, you can choose to promptly create, manage, and distribute Content through your Adsparo account.

    Personal Information We Collect

    Personal information is information related to an identified or identifiable natural person. An identifiable natural person is an individual that can be identified, directly or indirectly, by reference to an identifier such as a name, an identification number, specific location data, an online identifier, or other attributes specific to that natural person.

    Personal information does not include information that has been anonymized or aggregated in such a way that it can no longer be used to identify a specific natural person, whether on its own or in combination with other information.

    The personal information that we collect falls into two broad categories:

    Account Data

    Account data (“Account Data”) is personal information you provide us, or that we collect from you and your devices in connection with your access to and use of our web application (such as when you provide us information to register for an account, etc.). In legal terms, we collect and use this Account Data as a data controller. There are two general categories of Account Data we collect to provide you with the Services.

    1. Information you give us

    Personal Information: You may provide us with information in connection with the creation and management of your account for the Services, such as a name, email address, and password to create an Adsparo account.

    Business information: You may provide us with business information such as a name, a logo, an industry, a contact number, an email address, a website URL, and a physical address so that you can receive best-suggested content (social media posts, ad creatives, review templates, ad copies) from Adsparo.

    Other information: You may otherwise choose to provide us with information when you link your Social Network profiles with your Adsparo profile.

    2. Information we automatically collect from your use of the Services

    Log data and usage information:We want to inform you that whenever you use our Service, in the case of an error in the app we collect data and information (through third-party services) on your phone or desktop called Log Data. This Log Data may include information such as your device Internet Protocol (“IP”) address, device name, operating system version, the configuration of the app when utilizing our Service, the time and date of your use of the Service, and other statistics.

    Content or creative

    The content that you upload, download, or view on our web app (defined as “Content” in our Terms) may, but does not necessarily, contain personal information. When we refer to “Content” in this notice, we mean the personal information in the Content that we process. We only process Content at your direction. In legal terms, we act as data processors for the personal information included in the Content. Our obligations and commitments as they relate to our processing of Content on behalf of our users are outlined in the section below called Content – Adsparo as a Data Processor.

    We use, store, and process Account Data as a data controller to provide, understand, and improve our apps and to comply with our legal obligations. More particularly, we use it to:

    Content - Adsparo as a Data Processor

    You, as an Adsparo user, control how Content is requested, submitted, or published, and processed on our web application. When you use our web app, you may view, upload, and analyze Content that will ultimately be published on various Social Networks and digital platforms. You can also choose to access and/or link your Adsparo account to a wide range of Third-Party Apps. When you link these Third-Party Apps to your Adsparo account, you allow those Third-Party apps to access and process Content. The Content that flows through our web app may include personal information of all types, including but not limited to the following categories:

    As the user, you are the data controller of your Content and we are the data processor for such Content. When we process Content, we do so at your direction and on your behalf per the instructions you give us through the web app. When you connect your social media accounts through our web app, we only access, process, and use the Content to provide our services subject to the Terms and the various terms and conditions imposed by the Social Networks. We may, in limited circumstances process Content to improve the web app and functionalities users ask for as part of their Adsparo experience

    Social Networks

    The Adsparo web app enables an ecosystem where you can choose to connect your Adsparo account with Social Networks. If you choose to send your Content to a Social Network, Adsparo is no longer responsible for that Content from the point in time that it leaves Adsparo’s web app. We encourage you to carefully review the privacy policies of any Social Networks you access via our web app.


    Access, correction, and deletion of Content

    You should be aware that Adsparo acts as a conduit between you and the various Social Networks. In several instances, the Content published via Adsparo will not be in Adsparo’s custody, and any Content that has been shared by you through any Social Networks via web app may continue to be available to third parties and the public at large, as this Content is now under the control of the operators of the Social Networks.

    COPPA (Children Online Privacy Protection Act)

    When it comes to the collection of personal information from children under the age of 13 years old, the Children’s Online Privacy Protection Act (COPPA) puts parents in control. The Federal Trade Commission, and The United States consumer protection agency, enforce the COPPA Rule, which spells out what operators of websites and online services must do to protect children’s privacy and safety online. We do not knowingly collect or solicit personal information from anyone under the age of 13. If we learn that we have collected personal information from a child under age 13, we will delete the information we have stored as quickly as possible. We cannot ensure, and do not warrant or guarantee, that the information you transmit to Adsparo will remain secure, nor do we guarantee that this information will not be accessed, disclosed, altered, destroyed, or used in an unauthorized manner.

    If we learn of a security breach, we may attempt to notify you electronically so that you can take appropriate protective steps. We may also post a notice on the Site or Adsparo Services if a security breach occurs. Depending on where you live, you may have a legal right to receive a notice of a security breach in writing.     Image Usage From Third-Party Sources

    By utilizing images sourced from third-party platforms such as Adobe Stock, Freepik, Unsplash, Pexels, Pixabay, or similar platforms, we ensure specific usage rights, restrictions, and attribution requirements, as specified and outlined by the image’s provider's respective licensed terms.

    The use of images sourced from third-party platforms implies consent to abide by their terms and privacy policies, and Pactina ensures that there is no unauthorized or improper use in any form or manner.

    Data Retention

    How long we keep the personal information we collect depends on the type of information, the purpose for which it is used, how sensitive it is, and similar factors. In general, we will retain your personal information for the length of time reasonably needed to fulfill the purposes outlined in this privacy policy (including for as long as needed to provide you or our customer with products and services), unless a longer retention period is required or permitted by law. We will also retain and use your information for as long as necessary to resolve disputes and/or enforce our rights and agreements. We retain your account information for the Adsparo Services for as long as your account is active and thereafter unless you request deletion. Anonymous and aggregated information may be stored indefinitely.

    Effective January 1, 2020, the California Consumer Privacy Act of 2018 (the “CCPA”) allows consumers who are California residents, upon a verifiable consumer request, to request from a business:

    Delete any personal information about the consumer that the business has collected from the consumer;

    Disclose to the consumer certain information about the personal information that the business collects from the consumer; and Direct a business that sells personal information about the consumer to third parties not to sell the consumer’s personal information

    Adsparo does not sell any consumer personal information to third parties. To submit data access or data deletion requests, please visit our portal or contact us at support@adsparolab.com. Please note that these requests apply only to information that Adsparo holds as a “controller.” If your request relates to the personal data collected through a customer’s websites or digital products, you should direct your request to the owner of that website or product. Please note that you must verify your identity and request before Adsparo will process your request. You may be required to provide email confirmation or other information for us to verify your identity. Consistent with California law, if you choose to exercise your rights, you will not receive discriminatory treatment by Adsparo.

    Under certain circumstances, you may designate an authorized agent to request on your behalf. To designate an authorized agent to request on your behalf, you must provide a valid power of attorney, your valid government-issued identification, and the authorized agent’s valid government-issued identification to allow Adsparo to verify that the agent is authorized to request on your behalf.

    CA Civil Code § 1798.83 permits California residents to request and obtain from Adsparo once a year, free of charge, a list of the third parties to whom Adsparo may have disclosed their personal information (if any) for their direct marketing purposes in the prior calendar year, as well as the type of personal information disclosed to those third parties. As a general policy, Adsparo does not share personal information with third parties for their own direct marketing purposes without your prior consent. Accordingly, you can prevent disclosure of your personal information to third parties for their direct marketing purposes by withholding consent.
